Преамбулы конституций: современное состояние научных исследований
Аннотация
Цель данной статьи состоит в анализе сложившихся и в выявлении формирующихся в настоящее время подходов к трактовке положений преамбул современных конституций. Для выявления взаимосвязей и закономерностей развития научного знания о преамбулах конституций использован компаративистский метод. Показаны особенности конституционных преамбул как объекта научных исследований. Определено, какие именно аспекты преамбул чаще всего становятся объектом исследования. Охарактеризованы основные научные дискуссии, ведущиеся относительно содержания и значения преамбул. В центре внимания находится состояние научных исследований по трем взаимосвязанным проблемам: происхождение преамбул конституций, их содержание и юридическая природа. Анализ происхождения преамбул конституций использован для выявления истоков наблюдаемого в настоящее время разнообразия их содержания и их современной роли в конституционном регулировании. Показано, какие черты первых конституций стали основой для развития содержания преамбул более поздних конституций. В силу значительного разнообразия содержания современных конституций ученые предпринимают попытки выявить общие черты положений их преамбул. Показаны разработанные к настоящему времени типы классификаций содержания преамбул конституций. Выявлено, что их вариабельность зависит от региональной принадлежности конституций, отобранных для анализа, и от количества рассмотренных конституций. Решение вопроса о юридической силе преамбулы предопределяется особенностями содержания и формулировок положений преамбул конституций, сложившимся доктринальным подходом, а также позицией органов конституционного контроля, которая может изменяться от отрицания юридической силы преамбулы к ее признанию. Описаны основные варианты подходов органов конституционного контроля к вопросу о юридической силе конституций. Происходящие в настоящее время изменения роли и значения преамбул конституций, по мнению автора, предопределены прежде всего тем, что в них наряду с традиционными компонентами включают новые значимые для государства и общества идеи и принципы, почерпнутые из международного права и из конституций других стран.
