Шариат как элемент публичного порядка в арабских странах
Аннотация
Заметное место, которое исламское право продолжает занимать в правовых системах большинства арабских стран, проявляется в различных формах. Одной из них выступает статус шариата в целом или его отдельных институтов и положений как элемента публичного порядка. Такая роль исламских предписаний привлекает внимание в связи с применением норм иностранного законодательства, а также с исполнением зарубежных судебных и арбитражных решений в указанных странах. Традиционный фикх (исламская наука о правилах поведения и оценках любых явлений, имеющих внешнее выражение) не разрабатывал понятие публичного порядка, но обосновал ряд концепций, которые используются исламской мыслью при подходе к этому феномену. Современное исламское правоведение отождествляет публичный порядок с категорией общего блага и положениями шариата, которые отличаются точным закреплением и однозначным пониманием мусульманскими факихами — знатоками фикха. Законодательство почти всех арабских стран относит шариат в целом либо его конкретные институты и постулаты к публичному порядку. Чаще всего такой характер придается многим положениям законодательства по вопросам личного статуса, в частности, регулирующего брачно-семейные и наследственные отношения в соответствии с предписаниями шариата. Одновременно элементом публичного порядка во многих рассматриваемых странах считается шариатский запрет на проценты по займам или за просрочку исполнения имущественного обязательства. В отдельных случаях в качестве нарушения публичного порядка оценивается вероотступничество — выход из ислама. Наряду с законодательным закреплением важную роль в определении места шариатских предписаний в публичном порядке играет судебная практика. Органы правосудия различных уровней (включая верховные суды и институты конституционного контроля) в арабских странах в своих решениях определяют положения Корана и Сунны Пророка Мухаммада, относящиеся к публичному порядку, уточняют их толкование, конкретизируют нормы законодательства. Судебная практика лежит в основе разрабатываемого современной исламской правовой наукой понятия «исламский публичный порядок».
