Семейное предпринимательство: рассуждения о социальной и правовой реальности
Аннотация
Тесная связь семьи и коммерческой деятельности прослеживается в истории человечества. Семья как социальный институт определяет субъектный состав и отдельные особенности ведения предпринимательской деятельности. В доктрине российского права формируется убеждение в необходимости легализации и нормативного закрепления семейного предпринимательства. Общий анализ указанной концепции позволяет установить ее основные элементы: законодательная фиксация понятия семейного предприятия и создание системы мер государственной поддержки. Такой подход позволяет использовать системный и структурно-функциональный методы для оценки допустимости соединения семейного и предпринимательского начал в единой конфигурации и определить обоснованность создания им преимуществ на товарных рынках. В исследованиях получил подтверждение тезис о существенных препятствиях на пути реализации модели семейного предпринимательства. Доктринальные признаки семейных предприятий не имеют необходимой аргументации и вызывают сомнения с точки зрения юридической техники. Структурный анализ частных особенностей концепции семейного предпринимательства позволил выявить ряд проблем, требующих доктринального осмысления. Подлежит обстоятельному обоснованию целесообразность введения новой правовой формы, а также преференций семейному предпринимательству. Концептуальный анализ должен исходить из реальности, а не строиться на идеализированном представлении о семье. Следует в полном объеме проанализировать, с одной стороны, деструктивное влияние предпринимательского интереса на внутренний климат семьи, а с другой — воздействие семейных неурядиц на ведение бизнеса. Спорна возможность соединения начал семейного и предпринимательского права. С прикладной точки зрения трудности составляют несовместимость моделей принятия решений в семейном и корпоративном праве, различия договорных форм, установление семейных предпочтений при регулировании трудовых отношений, потенциальная несовместимость режима семейного предпринимательства с запретами антимонопольного законодательства. Авторские соображения по проблемам семейного предпринимательства следует рассматривать как элемент дискуссии, доводы, которые должны быть приняты во внимание в процессе возможной разработки специального законодательства.
