Наемный труд, цифровой труд и цифровые трудовые права в мире, управляемом искусственным интеллектом
Аннотация
Переход научно-технологического уклада от Индустрии 4.0 к Индустрии 5.0 будет сопровождаться изменением парадигмы категории «труд», стиранием «водораздела» между «трудом» и «работой». Кроме того, продолжится размывание признаков классического трудового правоотношения и сужение сферы применения наемного труда. Трудовая деятельность человека все больше будет осуществляться через компьютеры, мобильные устройства и онлайн-приложения в дистанционном формате, работников станут заменять искусственные интеллектуальные и гибридные системы, в том числе роботы, дополненные искусственным интеллектом, и киборги. Все это способствует появлению такого нового феномена, как цифровой труд. Авторами проанализирован феномен цифрового труда, проведено его сравнение с трудом наемным, определены субъекты, осуществляющие цифровой труд, и цифровые инструменты (как правило, являющиеся продуктами на основе искусственного интеллекта и смежных цифровых технологий), применяемые в процессе цифрового труда. В статье изложены концептуальные идеи относительно интеллектуально-волевых признаков субъектов такого труда, их влияния на трудовую правосубъектность и наличия или отсутствия последней у интеллектуальных роботов, киборгов, иных гибридных систем либо цифровых сущностей. Обосновывается новая концепция цифровых трудовых прав, тесно связанная с недавно обозначенной в науке трудового права концепцией цифрового трудового правоотношения. Цифровые трудовые права, носителями которых становятся не только «классические» работники, но и потенциальные «цифровые» работники, нуждаются в научном определении, классификации и соотношении с основными трудовыми правами работников, а равно — в последующем законодательном урегулировании. Авторами высказаны предложения по устранению пробелов в части регламентации цифровых трудовых прав и адаптации традиционных трудовых прав, модифицируемых в цифровую эпоху, de lege ferenda — нормами трудового законодательства: в частности, права работодателя на ознакомление с «цифровым следом» работника, права работника на защиту своего цифрового профиля, права работника и платформенного занятого на отключение и др.
