Обеспечение заработной платы в условиях гибридных правовых режимов
Рецензия на монографию А.Я. Петрова «Заработная плата в России: история, теория, право». М.: Проспект, 2024. 400 с.
Аннотация
Анализируются исследованные в монографии теоретические проблемы, историографические контексты концептуализации и правовое регулирование института оплаты труда в России в условиях гибридных правовых режимов. Подчеркивается высокая востребованность книги в силу длительного перерыва в монографических работах по этой сложной и динамичной проблематике. Обращается внимание на использованный автором массив научных трудов, нормативного материала, включая многочисленные подзаконные и социально-партнерские акты, а также широкое привлечение судебной практики. Структура монографии обусловлена многоаспектностью проблем правового регулирования заработной платы в России, соответствует обозначенным целевым ориентирам, модели отраслевого института и логике изложения вопросов. Автору высказано пожелание в дальнейшем усилить междисциплинарный подход для совершенствования гарантий получения заработной платы при несостоятельности работодателя и оплате труда с использованием цифровых финансовых активов, в том числе цифрового рубля. Рецензируемая монография вносит весомый вклад в науку трудового права, практику правового регулирования оплаты труда, позволяет на базе отечественного и зарубежного опыта сформировать научно обоснованную и практически верифицированную оригинальную национальную правовую модель нормативного упорядочения заработной платы в условиях гибридного правоприменения, сопутствующего глобальной трансформации производственных и общественных отношений.
