Отношения по фактическому воспитанию ребенка: проблемы семейно-правовой институционализации
Аннотация
Анализируя современное состояние проблемы и рассматривая фактическое воспитание ребенка как вид воспитания семейного, автор задается вопросом, каким требованиям должна отвечать относительно законченная концепция фактического воспитания ребенка, чтобы можно было признать проблему если не решенной, то хотя бы внести в нее исследовательскую новизну. Ее сегодняшнее состояние видится критичным с точки зрения теоретического инструментария, в структуре которого анализ преобладает над синтезом и присутствует неизменное погружение в сущее с выдачей законодателю рекомендаций на языке специалистов социального сервиса. При этом наука не задается вопросом, чем обусловлена позиция законодателя, отрешившегося от позитивно-статусного регулирования отношений фактического воспитания ребенка и оставившего их в разряде непосредственных. Доктринальное отношение к такому положению вещей обычно исчерпывается несогласием. Подобные взгляды не только не отражают современного социального настроя государственной политики в вопросах семьи и детствосбережения, но и сообщают проблеме культурную ограниченность, следствием которой оказывается недооценка отношений по фактическому воспитанию как значимого внутрисемейного воспитательного ресурса. Автор предлагает более пространный взгляд на проблему, позволяющий придать ей необходимую динамику, конкуренцию концепций, методов и способов описания. Сопоставляя исследуемую проблему с достижениями окружающих ее социо-гуманитарных исследований, автор не находит оснований для поддержки распространенных научных взглядов о том, что фактическое воспитание — это явление ослабленное и незащищенное с точки зрения интересов ребенка. Рассуждая о способах возможного законодательного участия в этом виде общественных отношений, автор утверждает, что современные законодательные попытки вмешательства в эти отношения возможны лишь в одном направлении — за счет придания им качеств, свидетельствующих о производности этих отношений от отношений по семейному праву.
