Особенности собирания уголовных доказательств, находящихся за рубежом

Аннотация

В статье рассматривается ряд особенностей как организационно-правового, так и процессуального характера формирования доказательств по уголовным делам, находящихся на территории иностранных государств. Целью автора является перечисление и изучение всех законных способов получения уголовных доказательств из-за рубежа. Использованы материалистическая диалектика, юридическая герменевтика (правовая экзегеза), специально-юридический, сравнительно-правовой методы, социологический подход и метод прогнозирования. Показано, что выбор способа собирания доказательств, находящихся за рубежом, напрямую зависит от обстоятельств международного сотрудничества и самой доказательственной информации. Автор приходит к выводу, что на сегодняшний день собирание экстерриториальных уголовных доказательств возможно посредством использования механизма взаимной правовой помощи по уголовным делам или правоохранительного содействия, в том числе путем создания совместных (международных) следственных групп, оказания консульской правовой помощи по уголовным делам, а также в ходе непосредственного производства следственных и иных процессуальных действий на территории иностранных государств. Кроме того, предпринята попытка проанализировать особенности и трудности получения электронной информации по уголовным делам, которая располагается за рубежом. Автором дан краткий обзор положений так называемого «Облачного закона», принятого в Соединенных Штатах Америки. В качестве эмпирической базы исследования использованы материалы уголовных дел, приговоры российских и иностранных судов, а также документы ведомственного характера и международных организаций.
